Sri Satyendra Narayan Singh, learned counsel for the applicant and learned A.G.A. for the State and perused the material on record.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the entire proceeding of Case No. 1044 of 2021 (State Vs. Yashpal & Others) arising out of Case Crime No. 38 of 2020, under Sections 323, 504, 506, 452 of Indian Penal Code, registered at Police Station- Dankaur, District- Gautam Budh Nagar as well as Charge Sheet dated 28.10.2020, pending in the court of Additional Chief Judicial Magistrate-I, Gautam Budh Nagar, and also cognizance order dated 13.07.2021.
Upon considering the facts and circumstances of the case, the prayer made by learned counsel for the applicant is hereby refused.
After some arguments, learned counsel for the applicant wants to withdrawn the application with liberty to file a bail application before the court of competent jurisdiction.
In view of the above, the application is disposed of as withdrawn with liberty to the applicant to file an appropriate application for bail before the court below in terms of the decisions rendered by the Supreme Court in Satender Kumar Antil Vs. Central Bureau of Investigation & Another, Special Leave to Appeal (Crl.) No(s). 5191 of 2021 decided on 07.10.2021.
