Supplementary affidavit filed today is also taken on record.
Heard Sri Akhilesh Kumar, learned counsel for the petitioner and learned Standing Counsel for respondents State.
At the very outset, learned Standing Counsel has pointed out that prayer made in the writ petition has been complied by respondents State authorities and the fair price shop license of the petitioner has been restored on 18.08.2021. An intimation has already been sent by registered post on 21.08.2021. In the instructions so received, order of appellate court has been complied with by the respondents State.
Learned counsel for the petitioner submitted that though the license has been restored but the EPOS machine has not been issued and the order of the appellate court has not been complied with in letter and spirit.
From the perusal of the prayer made in the writ petition, it transpires that prayer is only is only for the compliance of the order of the appellate court dated 04.03.2021 whereby the appeal was allowed and the fair price license was restored to the petitioner. Once the authority has restored the license on 18.08.2021 and the intimation having been sent on 21.08.2021, no cause of action survives.
In view of above, writ petition stands disposed of.
