The present writ petition has been filed with the prayer to quash the First Information Report dated 12.11.2019 registered as Case Crime no.74/2019 under Section 363, 366, 504, 120-B IPC, P.S. Khajani, District Gorakhpur. Further prayer has been made not to arrest the petitioner in the aforesaid case.
On the matter being taken up today, Shri Naushad Alam, Advocate holding brief of Shri Arvind Prabodh Dubey, learned counsel for the petitioner submits that charge-sheet has already been submitted in the matter and as such the writ petition has rendered itself as infructuous, however, leave may be accorded to avail the remedy as available in law.
In view of the above, the writ petition is dismissed as having become infructuous with the aforesaid liberty.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
