The present application has been filed by the convict under Section 439 of the Code of Criminal Procedure for the grant of temporary bail.
The applicant-accused is charged with having committed offences under Sections 306, 386, 506(2), 507 and 114 of the Indian Penal Code, for which, FIR being C.R.NO.I-174/2010 has been registered with Vejalpur Police Station, Ahmedabad City.
Learned A.P.P., Ms.Nair has placed on record the report, which is against the convict.
In view of the said report, learned counsel, Mr.K.U. Mishra seeks permission to withdraw this application with a liberty to file fresh application as and when there is any surgery or angiography is to be made. Permission, as prayed for, is granted. This application stands disposed of as withdrawn. Rule is discharged.
