ORDER:
The marriage between the petitioner and the respondent took place, on 27.04.2008. Shortly thereafter, differences arose and they started living separately. The respondent filed H.M.O.P.No.1 of 2010 in the Court of Senior Civil Judge, Parvathipuram, Vizianagaram District, against the petitioner, for divorce. The petitioner states that on being deserted by the respondent, she is residing at Saroornagar with her paternal uncle and that it is difficult and unsafe for her to attend the Court of Senior Civil Judge, Parvathipuram. It is also stated that the respondent is employed at Suryapet and he filed O.P. at Parvathipuram only with the object of harassing her.
Heard learned counsel for the petitioner and learned counsel for the respondent.
It is not in dispute that the petitioner is residing at Saroornagar. The averment of the petitioner that the respondent is also employed at Suryapet is not disputed. The distance between Hyderabad and Parvathipuram is almost prohibitive for a woman, who does not have a male assistance. Huge expenditure is also involved. If what is stated by the petitioner as regards the employment of the respondent is true, the Court at L.B.Nagar would suit both the parties. At any rate, the convenience of a woman spouse is important in determining the forum in which the proceedings have to be continued.
Hence, the Tr.C.M.P. is allowed and O.P.No.1 of 2010 is transferred from the Court of Senior Civil Judge, Parvathipuram to the Family Court at Ranga Reddy.
There shall be no order as to costs.
