The instant application under section 482 Cr.P.C. has been filed for quashing of the proceedings of the complaint case no. 5097 of 2004 (Smt. Urmila Singh Vs. Shiv Shankr and others), under section 498-A IPC and 4 D.P. Act, P.S. Mohammadabad, District Mau, pending in the court of CJM, Mau including summoning order dated 1.9.1995 and bailable warrant dated 5.4.2014.
Learned counsel for the applicant has made limited prayer that the applicant is willing and ready to appear before the court below as directed by this Hon'ble Court.
In view of the facts and circumstances of the case, this application is disposed of with direction that the applicant shall appear on or before 12.12.2018 before the court along with appropriate application and the same shall be decided expeditiously, preferably within two months from the date a certified copy of this order is produced before it.
Till the disposal of the said application the non bailable warrant dated 5.4.2014 shall be kept in abeyance.
The application U/s 482 Cr.P.C. is disposed of accordingly.
