Heard Sri Nasiruzzaman, learned counsel for the petitioner and learned Standing Counsel for the State.
The claim of the petitioner is that he was allotted a shop in District Collectrate compound in an auction for a fix period of one year on 24.3.2018 on rent for a sum of Rs.1530/-. The petitioner did not deposit the rent amount, therefore, an order has been passed for the remainder period of shop to be given to the respondent No.3. On coming to know of the aforesaid order, the petitioner claims that he has deposited the entire amount and for the remaining months he may be allowed to continue as the auction is for one year.
If the petitioner has already deposited the money and if the petitioner has been running a shop in the past also, his claim may be considered and appropriate order be passed by the City Magistrate upon petitioner moving an appropriate application alongwith certified copy of this order. The said order be passed within a month from today.
With the aforesaid observation, the writ petition is disposed of.
