The State By Vidhanasoudha Police Station Represented by the Public Prosecutor Bengaluru-560001 …Respondent (By Sri Rohith B.J., HCGP) This Criminal Petition is filed under Section 439 of Cr.P.C. praying to enlarge the petitioner on bail in Cr.No.16/2018 (S.C.No.943/2018) of Vidhana Soudha P.S., Bengaluru for the offence punishable under Sections 450, 341, 333, 332, 307, 353 of IPC.
This Criminal Petition coming on for Orders this day, the Court made the following:
O R D E R Learned counsel for the petitioner seeks permission to withdraw the petition and also sought for a direction to the trial Court to dispose of the main case itself within six months from the date of receipt of the copy of this order.
2. As seen from the records, accused has been languishing in jail for more than 1 ½ years. Therefore, it is just and necessary to direct the trial Court to dispose of the case, as expeditiously as possible, within six months preferably, from the date of receipt of copy of this order.
3. Hence, petition is dismissed. The trial Court is hereby directed to dispose of the main case itself as expeditiously as possible, preferably within six months from the date of receipt of the copy of the order. If the case is not disposed of within six months, petitioner is at liberty to renew his application for bail before the trial Court.
