1. By way of the present application, the applicant has prayed for releasing him on temporary bail for a period of 30 days on the ground of death of his mother who expired on 24.12.2011.

Chetna Shah, learned APP has produced a communication dated 05.01.2012 issued by the District Superintendent of Police, Mehsana confirming the death of the mother of the applicant - convict.
3. I have perused the jail record. It appears that whenever the applicant is released on furlough leave, he has surrendered in time and in past also, the applicant has never been released on temporary bail.
4. In view of the aforesaid facts and circumstances, the application requires consideration and therefore, the application is partly allowed. The applicant - convict shall be released on temporary bail for a period of three weeks from the date of his release on his executing a personal bond of Rs.5,000/- (Rupees five thousand only) to the satisfaction of the jail authority. Upon completion of the aforesaid period, the applicant shall surrender immediately before the jail authority.
5. The application is partly allowed in the aforesaid terms. Rule is made absolute to the aforesaid extent.
