Heard learned counsel for the applicant and learned AGA for the State and perused the record.
Present applicatoin has been filed with a prayer that the Court below i.e. Additional Chief Judicial Magistrate, Court No. 10 Azamgarh be directed to expedite the hearing and decide the Original Case No. 3620 of 2018 (State Vs. Teerath Ram) relating to Case Crime No. 103 of 2002, Under Section 323, 504 and 506 IPC, police station Deedarganj, District Azamgarh within a time bound period.
In the facts and circumstances of the case, the present application is finally disposed of with the direction to the learned trial court to expedite the trial of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of nine months provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With with aforesaid observations/directions, the present application is finally disposed of.
