Only prayer made in the present petition is to issue a direction to respondent no.4 to pay subsistence allowance to the petitioner applicable vide Government order with effect from the date of suspension.
A persual of the record indicates that the petitioner had challenged the suspension order by means of the writ petition no.12850 of 2018 (Tazneem Haider vs State of U.P and 3 others) which was disposed of on 28.5.2018 with the observation that the respondent may issue a chargesheet within a period of 15 days from the receipt of certified copy the order and the enquiry be concluded within further period of three months. It is contended that the order of the Writ Court was brought to the knowledge of the respondent. but the enquiry has not been completed. There is no indication as to whether chargesheet has been served on the petitioner or whether he is participating in the enquiry.
The assertions in the writ petition are vague. It is, therefore, kept open for the petitioner to move a proper representation before the respondent no.4, Chairman, Nagar Panchayat, Deoraniya, District Bareilly for release of subsistence allowance, after fulfilling all necessary conditions for payment thereof.
The writ petition is disposed of.
