Heard learned counsel for the petitioner and Mr. S.A. Murtaza, learned AGA for the respondents-State.
The writ petition seeks quashing of the First Information Report dated 10.11.2017 bearing Case Crime No. 954 of 2017 under Sections 354(B), 376, 511 and 506 I.P.C. of Police Station Surajpur, District Gautam Budh Nagar. This Court vide order dated 14.12.2017 had directed not to take any coercive action against the petitioner, however, no order of stay of the investigation was granted. This order is operating since December 2017. We are informed that investigation is in progress.
In view thereof, by consent, we dispose of the petition with direction to the Investigating Officer not to take any coercive action against the petitioner during pendency of investigation and till submission of charge sheet/final report, without prior permission of the concerned court.
