This court vide its order dated 01-09-2021 has asked the learned counsel for the opposite party to file medical report of the applicant with specific averments about the ailments of the applicant from which he is suffering and what treatment is being given to the applicant and what are the facilities available in the jail for treatment of ailment of the applicant.
In compliance of said order dated 01-09-2021, Supplementary Affidavit has been filed on behalf of opposite party. In the said Supplementary Affidavit, nothing has been stated except an enclosure has been filed sent by the Senior Consultant, District Jail Hospital, Lucknow, in which nothing has been mentioned that what treatment the applicant is getting and what are the facilities available in the jail.
Learned counsel for the applicant has submitted that at the time of discharge from the hospital on 16-08-2021, in the discharge summary, there is a column "Advice of discharge" wherein certain things are advised to be cared for the Chest Physiotherapy, maintain proper hygiene, daily dressing of stitch line, high protein diet, review in general surgery department, OPD on Wednesday after one week for stitch removal or in emergency SOS, but, nothing has been mentioned in the affidavit filed on behalf of the opposite party.
Sri Shiv P.Shukla, learned counsel fort the opposite party prays for and is granted one week time to file proper and better affidavit bringing on record the treatment which is given to the applicant as per the advice on discharge as mentioned in the discharge slip as well as facilities available in the hospital.
List this case within two weeks.
