Heard Sri Jamil Ahamad Azmi, learned counsel for the petitioner, Sri R.C. Upadhyay, learned counsel for the respondent no.5 and Sri Sanjay Ram Tripathi learned Standing Counsel for the State.
By order dated 5.4.2018 the learned Standing Counsel was required to obtain instructions on the action taken for appointment of the fair price shop dealer on the foot of the resolution of the village panchayat dated 19.12.2016.
Sri Sanjay Ram Tripathi, learned Standing Counsel submits on the basis of instructions received that resolution of the village panchayat dated 19.12.2016 has been found to be valid and in accordance with law. The competent authorities have also been directed to act in pursuance of the aforesaid resolution and appoint fair price shop dealer.
The instructions are kept in record.
No useful purpose would be served by keeping this writ petition pending in this court. With the consent of learned counsel for the parties the matter is being disposed of finally at the admission stage.
The respondent no.3, S.D.M., Ghosi, District Mau is directed to take appropriate steps which includes taking approval from the Tehsil Level Committee for appointment of the fair price shop dealer in accordance with law within a period of two weeks from the date of receipt of certified copy of this order.
The writ petition is disposed of finally with the aforesaid directions.
