JUDGMENT / ORDER

This writ petition has been filed to issue a writ of Mandamus directing the respondents to consider and pass orders on the petitioner's representation dated 19.06.2012 with regard to award/grant of Selection Grade/Special Grade from 02.10.1980 and 02.10.1990 respectively in the post of secondary grade teacher on that basis revision of pensionery benefits and disbursement of arrears.
2. According to the petitioner, he joined as a Junior Grade Teacher on 10.10.1996 in Puduchattram Panchayat Union, Namakkal District. Subsequently, he was promoted as a Secondary Grade Teacher on 02.10.1970 and he retired on 28.02.1991 on attaining the age of superannuation at Panchayat Union of Middle School, Vellaikadi, Yercard Union, Salem District.
3. It is the further case of the petitioner that he worked as a Secondary Grade Teacher from 02.10.1970 to 28.02.1991, but he was not awarded with Selection Grade and Special Grade by the respondent. After completion of ten years of service in the Selection Grade as Secondary Grade Teacher and twenty years of unblemished service, he has not suffered any punishment for the period from 02.10.1970 to 02.10.1990. As per the Government order, he is eligible to get Selection Grade and Special Grade. The petitioner gave a representation to the respondents dated 19.06.2012 for pensionary benefits and disbursement of arrears of pay and pension. Since the respondents did not consider the same, the petitioner has come forward with the present writ petition.
4. Heard the learned counsel appearing for the petitioner ; the learned Additional Government Pleader appearing for the respondents 1 to 4 and the learned counsel appearing for the 5th respondent.
5. The learned Special Government Pleader has also accepted the limited prayer sought by the petitioner.
6. Considering the limited prayer sought for by the petitioner, there shall be a direction to the respondents to consider the petitioner's representation dated 19.06.2012 by giving personal opportunity with regard to award/grant of Selection Grade/Special Grade from 02.10.1980 and 02.10.1990 respectively in the post of secondary grade teacher, on that basis, the respondent is directed to revise the pensionary benefits and disbursement of arrears thereby, within a period of twelve weeks from the date of receipt of a copy of this order.
With the above direction, this writ petition is disposed of. No costs.
