(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) By this Public Interest Litigation, the writ-petitioner has prayed for a direction directing the State to remove the respondent no.2 and other associates from the administration of Shri Deesa Agriculture Produce Market Committee[hereafter referred to as "the said Market Committee"] and also for direction upon the respondent no.1 to disqualify the present respondent no.2 and other members who are allegedly involved in the scam for contesting the next election as Chairman or member of the said Market Committee.
After going through the materials on record, we find that a criminal case has already been initiated and charge-sheet has also been filed against the Accountant and the Secretary of the said Market Committee.
In our opinion, at this stage, we should not pass any direction when allegations contained in the FIR against the accused persons are pending and there is no material to disqualify the respondent no.2 at this stage.
We thus find no merit in this Public Interest Litigation and the same is consequently dismissed.
