Heard Sri Anil Kumar Mishra, learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner is the recorded tenure-holder of Araji No. 1181 area 1.5940 hectare.
The Tehsildar in his report dated 10.05.2019 has accepted that the petitioner is the recorded bhoomidhar of the said land and that on spot, the land had been demarcated in the presence of the officers of the Forest Department and officers of the Forest Department are agreeable to the said demarcation.
Accordingly, Upziladhikari, Sadar, Sonbhadra vide letter dated 16.05.2019 informed the District Magistrate of the above facts and that the petitioner is the recorded bhoomidhar of the aforesaid demarcated land.
In view of the above report on record, the respondents are not justified in interfering in the petitioner's possession over the said land or with the construction of his boundary wall.
The writ petition stands disposed off accordingly.
