The prayer made in the instant petition is for issuing direction to the trial court to decide application 45-Ga filed by the defendant-petitioner in Original Suit No.303 of 2018 in a time bound manner. The petitioner has also prayed for a direction to the plaintiff-respondents to maintain status quo in the meantime.
At the time of making oral submission, counsel for the petitioner confined his prayer for a direction to the court below to decide the application 45-Ga, expeditiously.
Sri Ashish Kumar Singh, learned counsel appearing on behalf of respondent no.2 has no objection to the same. He states that the plaintiff-respondents will file objection to the application 45-Ga within a week.
Accordingly, the instant petition is disposed of with direction to the trial court to decide the application 45-Ga expeditiously, preferably within a period of two weeks from the date of production of certified copy of this order. The plaintiff- respondents shall positively file their objection within one week from today.
