Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the charge sheet dated 20.8.2017 as well as entire proceedings as Case No. 4448/2017 (State Vs. Dal Chand), in Case Crime No. 19 of 2013, under section 147, 148, 149, 307 I.P.C., Police Station Kosi Kalan, District Mathura, pending in the court of ACJM, Mathura.
Learned counsel for the applicant states that applicant has been falsely implicated in the case. The final report had been submitted thrice and it is only upon manipulation made by the informant, when ten investigating officers were changed, thereafter charge-sheet had been submitted against the applicant. It is further stated that the main accused is also on bail.
Shri Suraj Singh, learned AGA on the other hand submits that the applicant is named in the FIR and there are fire-arm injuries attributable to the applicant However, considering the nature of the allegations made in the F.I.R. and submissions made by learned counsel for the applicant, it is directed that in case the applicant appears before the court concerned within thirty days from today and applies for bail, the same shall be heard and disposed of expeditiously, strictly in accordance with law after hearing the public prosecutor keeping in mind the facts stated above.
For a period of 30 days from today, no coercive measure shall be taken against the applicant in the aforesaid case.
Once the applicant has been enlarged on bail, it shall remain open to him to apply for discharge.
With the above directions, this application is disposed of finally.
