Heard learned counsel for the parties.
This writ petition is directed against the order of Debt Recovery Tribunal dated 10.4.2019.
A preliminary objection has been raised by the learned counsel for the respondent bank that there is statutory remedy of appeal available to the petitioner and, therefore, writ is not maintainable in view of the judgment of the Apex Court in the case of United Bank of India v. Satyawati Tondon and Others, (2010) 8 SCC 110.
Learned counsel for the respondent bank states that there is no demand notice issued nor, any coercive measure has been taken against the applicant, therefore, writ petition is premature.
At this stage, learned counsel for the petitioner submits that he may be permitted to withdraw the writ petition.
As prayed, the writ petition is accordingly dismissed as withdrawn.
