On 8.4.2018, the following order was passed in the matter:-
"Grievance is that petitioner's retiral benefits have not been released despite an order passed by the Director of Education accepting petitioner's claim on 3.11.2014.
Learned Standing Counsel may obtain instructions in the matter. Post as fresh on 25.4.2018."
Learned standing counsel on the basis of instructions states that a subsequent order has been passed on 17.11.2017 holding that petitioner is not entitled to payment of pension as per Government Rules. Copy of the order has been made available to learned counsel for the petitioner, today, in the Court.
Sri Prabhakar Awasthi, learned counsel for the petitioner, in such circumstances comes up with a prayer to withdraw this petition with liberty to file afresh, challenging the order dated 17.11.2017.
Writ petition is accordingly dismissed, with liberty as prayed.
