Heard learned counsel for the petitioner and perused the record.
By means of this writ petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"(I). Issue order or direction in the nature of mandamus commanding the learned Civil Judge (Junior Division) Jaunpur to decide the 6C application dated 2nd January, 2017 in Suit No.- 03 of 2017 (Surendra Bahadur and others vs. Kamla Prasad Yadav and others) under Section 9 of C.P.C. pending before him within stipulated period as fixed by this Hon'ble Court."
Considering overall facts and circumstances of the case, this petition is disposed of with a direction to the court concerned to decide the aforesaid 6C application dated 2nd January, 2017 filed in Original Suit No.- 03 of 2017 (Surendra Bahadur and others vs. Kamla Prasad Yadav and others), strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of two months from the date of production of copy of this order.
It is provided that order available on the official website of the High Court will be taken to be authentic one.
