Heard Sri Diwanshu Tiwari (A/D0133/2018) holding brief of Sri Mithilesh Kumar Shukla, learned counsel for the petitioner and learned standing counsel for the respondents.
The petitioner in the writ petition is seeking a directing to the respondent no. 2 to initiate appropriate proceeding against respondent nos. 3 to 6 who are stated to have established forged firms, whose names are given in paragraph 5 of the writ petition and are engaged in the business of illegal stone mining.
The petitioner is stated to have preferred a representation dated 9.4.2019 to the respondent no.2 by registered post of the same date, a copy of which has been filed as Annexure 4 to the writ petition but nothing has been done so far.
No useful purpose will be served by keeping the matter pending.
We, therefore, dispose of this writ petition with the direction to the District Magistrate, respondent no.2 to consider and decide the representation dated 9.4.2019 of the petitioner in accordance with law expeditiously preferably within a further period of 3 months from the date of receipt of a certified copy of this order. Along with the certified copy of this order the petitioner shall also provide a copy of the said representation dated 9.4.2019.
It is made clear that the Court has not adjudicated the claim of the petitioners on merits.
