Heard learned counsel for the petitioner.
Sri Rohit Yadav, learned counsel has put in appearance on behalf of respondent-District Cooperative Bank Ltd.
This petition has been filed with the following prayer:
"(1) Issue a writ, order or direction in the nature of certiorari and set aside the impugned publication dated 5.3.2021/Notice dated 4.3.2021 (published in Amar Ujala dated 5.3.2021) issued by Respondents (Annexure No. 5) to the writ petition".
It is evident from the record that the petitioner has already filed a petition being Writ Petition No. 6337 of 2020, which was disposed of by this Court by an order dated 24.2.2020 permitting the petitioner to deposit the amount in instalments.
It is stated that due to Covid-19 pandemic, the petitioner could not arrange the amount and the order of this Court could not be complied with. It is further stated that a notice dated 24.2.2021 was received by him for payment of the amount and thereafter, a notice was published in the Newspaper on 5.3.2021 intimating the petitioner that in case he does not deposit the amount within fifteen days, the coercive steps would be taken against him.
Since, the earlier writ petition was filed by the petitioner himself and was disposed of permitting the petitioner to deposit the amount in instalment, this writ petition on similar set of fact, cannot be entertained.
This petition is, accordingly, dismissed. However, it will be open for the petitioner, if advised, to move an appropriate application in the previous writ petition.
