Shri Deepak Kumar Singh holding brief of Shri Rahul Agarwal, learned counsel for the respondents files counter affidavit today. The same is taken on record.
Heard Shri Pramod Kumar Shukla, learned counsel for the petitioner, Shri Deepak Kumar Singh holding brief of Shri Rahul Agarwal, learned counsel for the respondents no.2 to 4 and the learned Standing Counsel for the respondent no.1.
The petitioner in the writ petition is seeking quashing of the order dated 27.07.2017.
The petitioner is stated to be working as Driver under the respondents. By the impugned order he was sent for medical check up on 18.04.2016 but no medical report has been received thereafter. In pursuance of the said order he has not been allowed to join duty. The respondents in their counter affidavit have stated that a fresh Medical Board has been constituted by the respondents vide letter dated 18.11.2017 and they had directed the petitioner to get himself examined. According to the petitioner he has not received this letter.
Be that as it may, this writ petition is disposed of with a direction that if the petitioner presents himself alongwith certified copy of this order in the office of the respondent no.4, Regional Manager, Uttar Pradesh State Road Transport Corporation, Bhatauli Region, Saharanpur on 07th May, 2018 at 11.00 A.M., the respondent no.4 shall handover the petitioner a letter indicating on what date and at what time he will be required to appear before a Medical Board (specifically mentioning therein which Medical Board). Thereafter the petitioner shall present himself before the said Medical Board on the date and time, mentioned in the letter. The Medical Board shall thereafter examine him and submit its report to the respondent no.4 within a week. The respondent no.4 shall thereafter pass appropriate orders in accordance with law within a further period of one month.
