JUDGMENT / ORDER

(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) Issue notice, returnable on July 16, 2012. Since learned advocate Mr.Meena appears on behalf of respondent No.2, we dispense with service of notice upon respondent No.2.
We also dispense with service of notice upon the respondent No.1 as for effective adjudication of the dispute involved in the present application, presence of respondent No.1 is not necessary.
After hearing the learned counsel for the parties, we pass an interim order to the effect that the petitioner is permitted to have a trial run of the industrial plant for seven days. The Gujarat Pollution Control Board will inspect the unit of the petitioner in the course of these seven days and on the expiry of the seven days from the start of the trial run, if the analysis of the sample collected from the final outset of the ETP meets with the parameters prescribed by GPCB, the petitioner shall be permitted to continue operation of its plant for a further period of three months. GPCB will, however, take further samples after expiry of one month and give analysis report to the Court.
If during the trial run at any point of time the GPCB is of the view that from the sample recovered from the final outset of the ETP does not meet with the parameters prescribed by the GPCB, it will be open for the GPCB to pass direction for closure of the unit.
Let the matter appear on July 16, 2012. Direct Service is permitted.
