Heard Mr. Rajesh Kumar, learned counsel for the revisionist and the learned A.G.A. for the State.
This criminal revision is directed against the order dated 12.4.2018 passed by the Appellate Court that is the Additional Sessions Judge, Court No. 14, Varanasi, in Criminal Appeal No. 204 of 2017, (Sunil Rajbhar Vs. State of U.P. and another) arising out of judgement and order dated 12.4.2018 passed by the Judicial Magistrate Court No. 3, Varanasi, in Case No. 7237 of 2016, (Reenu Vs. Sunil Rajbhar), under section 12 of the Protection of Women From Domestic Violence Act, 2005, Police Station Chaubeypur, Distrit Varanasi.
It is an undisputed fact that the opposite party No. 2 is the legally wedded wife of the revisionist. The revisionist is under legal and moral obligation to maintain his wife. There is nothing on the record to suggest that the revisionist had taken due care and diligence to maintain his wife.
This being the position, no occasion arises before this Court to entertain the present criminal revision.
The criminal revision is dismissed.
