Petitioner was appointed to the post of Constable in Civil Police and has been transferred from Kanpur Nagar to Hamirpur, Chitrakoot Range vide order dated 9.8.2017. Petitioner was also relieved pursuant to such order in February, 2018. It is contended that petitioner was not well and he could recover from his illness only on 9.8.2018 and has joined pursuant to the order of transfer.
This petition has been filed with the grievance that the petitioner's transfer, itself, is illegal.
Petitioner opposed by learned Standing Counsel.
Admittedly, the petitioner holds a transferable post and transfer is an incidence of service. Petitioner has otherwise continued at Kanpur for more than six years.
In such circumstances, no interference with the order of transfer is called for particularly as neither any statutory rule is shown to have been violated nor any mala fide is alleged to be proved.
Writ petition lacks merit and is, accordingly, dismissed.
