The present bail application has been filed by the applicant in S.t. No. 308/2016 in Case Crime No. 198 of 2016, u/s 498A, 304B, 201 IPC and 3/4 D.P. Act, P.S. Bakewar District Etawah with the prayer for enlarging him on bail.
According to the prosecution, the marriage of the applicant was solemnized with the deceased about one year back and the applicant and his family members were ill-treated with the daughter of the informant on account of additional demand of dowry. It is further stated in the F.I.R. that the informant received an information on 12.5.2016 at 7.00 am that his daughter has been murdered by the applicant and his family members and her dead body was disposed of.
Having heard learned counsel for the parties and perused the record. I find that no information was given to the police about the incident, if the defence case that the deceased left home assume to be true then any information was given by the applicant or any of the family members to the police or the informant. The applicant being husband of the deceased has not offered any plausible explanation. I do not find it to be a fit case for enlarging the applicant on bail.
The bail application is, accordingly, rejected.
However, it has been stated by the counsel for the applicant is in jail since 13.5.2016. The trial court is directed to expedite the trial and conclude the same preferably within the period of nine months from the date of production of the certified copy of this order before the trial court.
