Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material available on record.
This applicant under Section 482 Cr.P.C. has been filed with the direction to the Additional District & Sessions Judge, Court No.2, Aligarh to conclude the trial of Criminal Case No. 0300012 of 2016 (State vs. Hari Mohan & others) Case Crime No. 218 of 2015, under Sections 147, 148, 149, 324, 323, 354, 504 IPC and 3(1) 10 SC/ST Act, P.S. Iglas, District Aligar.
Learned counsel for the applicant submits that the case is pending since 2016 in which applicant is first informant. In the case the charges have been framed against the opposite party Nos. 2 to 7 on 11.04.2017, since then aforesaid opposite parties are intentionally and deliberately adopting the tactics of adjourning the case without any justified reason. The pendency of the case is causing irreparable loss and mental agony to the applicant. Hence suitable directions may be issued to the court concerned for expeditious disposal of the case within stipulated time period.
Learned A.G.A. submits that the Court below is making all efforts to decide the case, and this Court may issue directions for time bound disposal of the case.
Having heard the learned counsel for the parties and perusal of material available on record, the Court below is directed to decide Criminal Case No. 0300012 of 2016 (State vs. Hari Mohan & others) Case Crime No. 218 of 2015, under Sections 147, 148, 149, 324, 323, 354, 504 IPC and 3(1) 10 SC/ST Act, P.S. Iglas, District Aliga, expeditiously. For the purpose no unnecessary adjournment shall be granted to either of the party and in case adjournment seems to be inevitable, same shall be granted on payment of heavy cost and for short period.
With above directions the application stands finally disposed off.
