Heard learned counsel for the parties and perused the record.
This writ petition has been filed, inter alia, for the following reliefs :-
(i) To issue writ order or direction in the nature of mandamus commanding the respondent No. 2 to provide security and police protection to the petitioner and other elected members of Zila Panchayat, Bulandshahar for the purpose of by- election to be held for the post of Adhyaksha of Zila Panchayat, Bulandshahar on 29.07.2019.
(ii) To issue writ order or direction in the nature of mandamus directing the respondent No. 2 to arrange the videography for the by-election to be held for the post of Adhyaksha of Zila Panchayat, Bulandshahar on 29.07.2019 in order to hold free and fair by-election.
Learned counsel for the petitioner is permitted to make necessary correction in the prayer clause of the petition.
Learned counsel for the petitioner submits that the petitioner along with other elected members of Zila Panchayat Bulandshahar, participate in the by-election for the post of Adhyaksha of Zila Panchayat, Bulandshahar which is to be held on 29.07.2019. In this regard, petitioners along with elected members have submitted representation before respondent No. 2 to provide security to them for the purpose of by-election, but till date neither respondent No. 2 has provided any security nor he has taken any action on the aforesaid representation.
Considering the facts and circumstances of the case and without expressing any opinion on merits of the case, this writ petition is finally disposed of with a direction to the petitioner to approach the respondent No.2, District Magistrate/District Election Officer, Bulandshahar, ventilating his grievances along with a certified copy of this order enclosing therewith a copy of the writ petition and its entire annexures and, if any such representation is made, respondent No.2, District Magistrate/District Election Officer, Bulandshahar, shall look into the matter and take all endeavours to consider and decide the same in accordance with law.
