Today, pursuant to the earlier direction dated 14.3.2012, Mr.Raval, learned APP for the respondent No.1 - State presented the investigation files along with the xerox copy of the alleged suicide note. It is further submitted that the original copy of the suicide note has been sent to F.S.L. for the opinion of handwriting expert, and the said opinion is yet to be collected. It is true that vide order dated 12.10.2010 passed in Criminal Misc.Application No.10374 of 2010, this Court issued the direction that the proceedings of C.R.No.I-102 of 2010, registered with Adalaj police station, shall remain stayed, but considering the facts and circumstances of the case, if the opinion of the handwriting expert of F.S.L. is obtained by the Investigating Police Officer for perusal of this Court, that would not come in way of the aforementioned stay order. Mr.Raval, learned APP for the respondent - State, upon instructions being received from ASI Valjibhai, Adalaj police station states that the report shall be collected and shall be brought to this Court on 28.03.2012.
