Sri Vikas Budhwar, learned counsel has appeared on instructions of the opposite party and states that the delay in implementation of the order of the writ Court has occurred primarily on account of a confusion with respect to the eligibility of members of the Jat Community being accorded benefit of reservation. According to Sri Budhwar, although Jat Community is included as OBC in U.P. Act No. 4 of 1994, the Corporation in terms of its guidelines is mandated to follow the list of OBCs as maintained by the Union Government. According to him, in a recent decision rendered by the Supreme Court, the Jat Communities have been held not to be entitled to the benefit of reservation.
Be that as it may, Sri Budhwar submits that while the Corporation reserves its right to move the Supreme Court seeking clarification, it shall provisionally issue a Letter of Intent subject to all its rights being reserved for consideration in the application which is proposed to be moved.
The statement so made is recorded and accepted. The Corporation may proceed to issue a provisional Letter of Intent within a period of 15 days from today.
The petition stands disposed of.
