Heard learned counsel for the petitioners, Sri Rohit Pandey, learned counsel for respondent nos. 2 and 3, Ms. Pooja Agrawal, learned counsel for respondent no.4 and perused the material brought on record.
By means of present writ petition, petitioners have sought following relief(s):
"(i) issue a writ order or direction in the nature of mandamus commanding to respondent to declare the results of the petitioners of First Semester studying in the Bachelor of Education Course 2019-21 being run by the college.
(ii) issue a writ, order or direction in the nature of mandamus commanding to direct the respondent no.4 to permit the petitioners for applying in the next Semester i.e. Second Semester for the Academic Year 2020-21 of Bachelor of Education Course recognized by the respondent no.4.
(iii) issue any such other and further suitable writ order or direction which this Hon'ble Court may deem fit and proper under the facts and circumstances.
(iv) award the cost of the writ petition to the petitioners."
The petitioners are aggrieved by the act of respondent no.4 for declaration of the result of first semester in question and also admission to the second semester for the year 2020-21 for B.Ed. course recognized by the respondent no.4, as such.
In this regard, it has been claimed that one representation was also moved by the petitioners. Copy whereof has been placed on record vide Annexure No.7 to the writ petition.
Ms. Pooja Agrawal, learned counsel for respondent no.4 claims that in this case actually in fact it so happened that the petitioners were permitted to appear though provisionally in the examination, however after calling the list of the eligible candidates, the name of the petitioners were missing from the list, due to which, their results could not be declared. However, the matter will be looked into after representation is made by the petitioners and so far as the second prayer sought by the petitioners are concerned, the same relates to the admission in second semester, then it is obvious that the limit/date fixed for taking admission was not properly followed and because of the lapse on the part of the petitioners, they could not be given admission in the second semester. However, in case they move representation, the same shall be considered in due course.
It is expected that in case the petitioners move fresh representation and fulfils the requirement and is ready to complete all any necessary requirement as has been sought by the institution say respondent no.4, then the needful shall be considered by the authority concerned and representation shall be accordingly disposed of within one month next after presentation of certified copy of this order.
With the aforesaid direction, this petition is disposed of.
