This petition is directed against an order dated 7.6.2017 passed by the Additional Director General of Police, Varanasi Region, Varanasi whereby petitioner's representation dated 6.1.2017 has been rejected in compliance of the orders passed by this Court on 21.2.2017.
Petitioners are the parents of the deceased constable Raj Kumar Jaiswal who died in a road accident in the year 2015. Their dispute basically is with their daughter-in-law i.e. respondent no. 6. According to the petitioners, their daughter-in-law is not taking care of them and is now living at her parental place.
A perusal of the order impugned would go to show that though objection was initially made by petitioners against the claim of their daughter-in-law to receive pension, but the petitioners appeared before the authority and contended that they have no objection in release of family pension in favour of respondent no. 6. The entitlement of respondent no. 6 to receive pension is otherwise not questioned inasmuch as she is the wife of the deceased. In case there are issues between the petitioners and respondent no. 6, or that she is not taking care of the aged parents, it is open for the petitioners to seek appropriate relief in the form of maintenance etc., if the law so permits, before the appropriate forum.
Leaving it open to the petitioners to pursue such remedy, this petition is consigned to records.
