Heard the learned advocate for the applicant and the learned A.P.P for the State.
2. Following aspects are considered :-
(i) Charge sheet has been filed;
(ii) Accusation against the applicant is of an offence punishable under Section 306 r.w.Section 114 IPC and Sections 3 & 4 of the Dowry Prohibition Act;
(iii) Post-mortem Note indicates that the deceased died of heart failure;
(iv) Accusation is of administering poison, whereas viscera does not indicate the presence of poison.
3. Considering the above aspects, the application deserves to be allowed and the same is allowed. The applicant is ordered to be released on bail in connection with Crime Register No. I. 28/2009 of Kothara Police Station, on his executing a bond of Rs. 10,000/- (Rupees Ten Thousand only) with one surety of the like amount to the satisfaction of the lower Court, subject to such conditions which the lower Court may deem fit to impose.
4. Rule is made absolute.
5. Direct Service is permitted.
