Heard learned counsel for the applicant and learned A.G.A. for the State and perused the material placed on record.
It is submitted by learned counsel for the applicant that the applicant is accused in the case. The trial is lingering on for past more than two years which may be directed to be concluded as early as possible.
However, record shows that initially charge sheet was submitted before the court and the court has taken cognizance on 07.1.2021. On another date accused was absent and summons were issued fixing 17.03.2021. There is no other order-sheet on record to show that any wilful delay has been caused by any of the parties.
Be that as it may, without expressing any opinion on the merits of the applicant's case, this application U/s 482 Cr.P.C. is finally disposed of with a direction to the court concerned to decide S.S.T. No. 01 of 2021 (State vs.Girish Chand Mishra and others) arising out of Case Crime No.147 of 2019 under Section 2/3 of U.P. Gangster Act, Police Station Ecoteck, District Gautam Budh Nagar, pending in the court of District Judge,Gautam Budh Nagar in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible, if there is no legal impediment.
