Heard learned counsel for the petitioner, Shri Rakesh Kumar Pandey, learned counsel for the Union of India, respondent No.1 and Shri H.N. Pandey, learned counsel for the respondent No.2.
Present Writ Petition under Article 226 of the Constitution of India has been filed seeking direction to the Secretary, C.B.S.E. Board Education, respondent No.2 to cancel the approval of the Institution namely, K.K. Public Academy, Bhatani, Deoria.
In para 4 of the writ Petition it is stated that the petitioner is permanent resident of the Village Mishroli Dixit, Post Office Bhatni, District Deoria and is a social worker.
Apparently no personal interest is involved in the present case. The cancellation of the recognition of the Institution in question was sought on the ground that false affidavit has been filed by the said Institution while obtaining the order of recognition. For the relief claimed in the Writ Petition, learned counsel for the petitioner cannot challenge the same until and unless he files Public Interest Litigation before the appropriate Bench.
Writ Petition lacks merit and is, accordingly, dismissed. Order Date :- 17.12.2019 T. Sinha
