Heard Shri S.N. Dubey, learned counsel for the petitioner.
From the averments in the writ petition it appears that the husband of the petitioner during his service period had been meeted with penalty order which he challenged in Writ Petition No.43864 of 2009 (Krishana Jeevan Mani Tripathi Vs. Assistant General Manager, The New India Assurance Co. Ltd. & Others) which was allowed by this Court vide its judgement dated 25.04.2017 and the penalty order as well as the appellate order has been set aside. The said Krishana Jeevan Mani Tripathi died during the pendency of the writ petition and after the judgment of the High Court the petitioner submitted her application before the Assistant General Manager, The New India Assurance Company Limited, Regional Office, Kanpur, respondent no.2 claiming family pension through her application dated 26.09.2017 by registered post of the same date, copy of which has been filed as Annexure-2 but no order has been passed till date.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.2, Assistant General Manager, The New India Assurance Company Limited, Regional Office, Kanpur to consider and decide the petitioner's pending representation/application dated 26.09.2017, Annexure-2 to the writ petition in accordance with law within a period of two months from the date a certified copy of this order is received in his office.
The petitioner shall also provide a copy of the representation dated 26.09.2017 alongwith the certified copy of this order to the respondent no.2.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
