Heard Sri Bhupesh Kumar Singh, learned Counsel for the petitioner, learned Standing Counsel for the State respondents and perused the record.
The instant writ petition under Article 226 of the Constitution of India has been filed for the following relief:-
"(a). issue a writ order or direction in the nature of mandamus directing the Tehsildar, Tehsil Soraon, District Prayagraj respondent no.2 to decide the Case No.T202002030305214 (Suman Devi Vs. Tribhuwan Singh) filed under Section 34 of U.P. Land Revenue Act, relating to Village Phaphamau, Pargana and Tehsil Soraon, District Prayagraj."
Learned Counsel for the petitioner submits that on the basis of registered sale deed dated 09.09.2020 executed by Tribhuwan Singh son of Ayodhya of Khasra No.246, 283, 284, 285, 286 area 0.1775 hectare situated at Phaphamau, Pargana and Tehsil Soraon, District Prayagraj the petitioner applied for mutation, which remain pending till date.
The order sheet of the case indicates that the case was adjourned either due to strike of lawyers or due to non-availability of presiding officer.
Learned Standing Counsel states that no useful purpose will be served in calling for the counter affidavit and keeping the writ petition pending as he has no objection in case a direction is issued to respondent no.2 to decide the matter of the petitioner within the time fixed by the Court.
Considering the facts and circumstances of the case, without going into its merit and with the consent of the parties, the writ petition is disposed of with a direction to the respondent no.2 to decide the Case No.T202002030305214 (Suman Devi Vs. Tribhuwan Singh) filed under Section 34 of U.P. Land Revenue Actpending before it expeditiously, in accordance with law, with due notice to affected parties, preferably within a period of six months from the date of production of a certified copy of this order if there is no legal impediment.
The Writ Petition is, accordingly, disposed off. No order as to costs.
