Herd Sri A.K.Singh, learned counsel for the applicant and Sri Sanjay Singh, learned AGA appearing for the State.
The modification application has been moved for modifying the order dated 1.10.2018 passed by this Court by which the applicant was granted bail with the condition that the applicant shall furnish two sureties of Rs.
1.00 lac each in which one should be of a family member.
Learned counsel for the applicant submits that the family members of the applicant are below the poverty line and earn their livelihood by doing labouring work on daily wages basis and having no moveable or immoveable property to his family members. To this effect learned counsel for the applicant has also annexed the income certificate of the applicant as Annexure-2 to the affidavit filed support of the modification application which has been issued by the Tahsildar, Loni,Ghziabad on 5.2.2018.
In view of the submission advance by the learned counsel for the applicant the order dated 1.10.2018 passed in the present bail application is hereby modified to the extent that furnishing two sureties of Rs.1.00 lac each with the condition that one should be of a family member stands deleted.
Learned court below is directed to release the applicant on furnishing a personal bond with two sureties each in the like anoint to the satisfaction of court concerned.
The modification application is accordingly disposed off.
