Heard Sri Gokaran Singh, learned counsel for the petitioner and learned Standing Counsel for respondents No.1 and 2. Notice need not be issued to respondents No.3 to 23 at this stage.
This writ petition has been filed with the following prayer:
"issue a writ order or direction in the nature of mandamus commanding to direct the Sub-Divisional Magistrate (S.D.M.) Tehsil- Ghosi, District-Mau to decide the case no.T20161551021478 of 2016 (Sudden Vs. Bhawdin and others), filed under Section 116 U.P. Rajaswa Sanhita 2006 expeditiously preferable within 4 months."
It is contended by counsel for the petitioner that proceedings under Section 116 of the U.P. Revenue Code, 2006 is pending since 2016. The sole prayer is for early disposal of the aforesaid proceedings.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit or issuing notice to respondents, with a direction upon respondent no. 2 to conclude the proceedings of aforesaid case, if there is no legal impediment, after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of six months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
