Heard learned counsel for the applicant and learned A.G.A. for the State.
A case under Section 145 Cr.P.C. being Case no. T201816670502324, under Section 145 Cr.P.C., Sudhir Kumar vs. Smt. Prem Lata and others, in respect of Arazi no.1112/1 situate at Village Pattibejav, Police Station Suriyanwa, Tehsil and Pargana Bhadohi, District Bhadohi is pending between parties.
The prayer in the present application is to expedite the proceedings of the said case and to decide the same within a determinant period of time.
All proceedings under Section 145 Cr.P.C. are inherently urgent in nature as these involve an apprehension about breach of piece over a dispute regarding immoveable property.
Taking the said fact into consideration and the fact that an application under Section 145 Cr.P.C. is pending since 19.03.2018 along with a prayer for attachment under Section 146(1) Cr.P.C. pending decision of the proceedings wherein a preliminary order has been passed on 26.05.2018, it is directed that the Sub-Divisional Magistrate, Bhadohi, District Bhadohi shall proceed to decide the Case no. T201816670502324, under Section 145 Cr.P.C., Sudhir Kumar vs. Smt. Prem Lata and others, in respect of Arazi no.1112/1 situated at Village Pattibejav, Police Station Suriyanwa, Tehsil and Pargana Bhadohi, District Bhadohi expeditiously within a period of three months next in accordance with law from the date of production of certified copy of this order, after hearing the parties.
This application stands disposed of with the above orders.
