Sudhir Kumar Singh vs Union Of India And Others

High Court Of Judicature at Allahabad|26 July, 2019
|

JUDGMENT / ORDER

Court No. - 55
Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 1491 of 2019 Petitioner :- Sudhir Kumar Singh Respondent :- Union Of India And 3 Others Counsel for Petitioner :- Ashok Kumar Yadav Counsel for Respondent :- A.S.G.I.
Hon'ble Vikram Nath,J. Hon'ble Pankaj Bhatia,J.
Heard Sri Ashok Kumar Yadav, learned counsel for the petitioner and Sri Rakesh Mohan, learned counsel representing the respondents. Sri Prateek Singh, learned Brief Holder for the State respondents.
By means of this petition, framed as a Public Interest Litigation (PIL), the petitioner has prayed for a direction to the Central Government and the concerned Ministry to withdraw its decision of closing down the Research Extension Centre, Silk Tussar, Bobertsganj, District Sonbhadra and to issue an appropriate direction to the respondents to ensure that the said centre be continued to work.
We are afraid that under Article 226 of the Constitution, we can deal with such issues as the decision is to be taken by the Government whether or not to close or run the extension centre, considering its feasibility.
Petition is accordingly dismissed.
Order Date :- 26.7.2019 RPS [Pankaj Bhatia, J.] [Vikram Nath, J.]
