JUDGMENT / ORDER

Court No. - 40
Case :- MATTERS UNDER ARTICLE 227 No. - 1221 of 2019 Petitioner :- Sudhir Kumar Dixit Respondent :- Civil Judge (Junior Division) Nagina Bijnor And 2 Others Counsel for Petitioner :- Dr. K.P. Bajpai
Hon'ble Anil Kumar,J.
Heard learned counsel for the petitioner and perused the record.
As the controversy involved in the present case is trivial in nature, so the present writ petition is finally heard and decided at the admission stage.
Accordingly, notices to opposite parties are dispensed with.
Learned counsel for petitioner submits that petitioner has filed a Civil Suit No. 684/2013 in the year 2013 but the same has not been decided till date on one or other pretext without any fault on the part of the petitioner.
Accordingly, he requests that respondent No. 1/Civil Judge (Jr. Div.), Nagina, Bijnor may be directed to decide the same within stipulated time as fixed by this Court as the petitioner is senior citizen, 85 years old.
Thus, after hearing learned counsel for parties and going through the record as well as keeping in view the fact that petitioner is a senior citizen 85 years old, the writ petition is disposed of with a direction to respondent No. 1/Civil Judge (Jr. Div.), Nagina, Bijnor to decide in Civil Suit No. 684/2013 expeditiously, say, within a period of two years, if possible, from the date of receiving certified copy of this order after hearing the parties concerned on merit.
It is clarified that this Court has not adjudicated the claim of the petitioner on merit.
