In terms of order dated 20.9.2017 in Criminal Misc. Writ Petition No.20258 of 2017, the District Magistrate was required to examine the complaint of the applicant filed under Regulation 7-A of the Uttar Pradesh Police Regulations within a period of three months from the date of receipt of certified copy of the order.
Counsel for the applicant submitted that a certified copy of the order of the Writ Court was submitted before the opposite party on 11.10.2017, but no decision has been taken in the matter so far.
Concededly, the order has not been sent to opposite party by registered post and it is not clear as to whether the order of the Writ Court is in his knowledge or not. As such, this Court is not inclined to proceed in contempt at this stage, but leaves it open to the applicant to communicate the order of the Writ Court to the opposite party by registered post as well as the order passed today in the instant petition and in which event, the opposite party shall be bound to follow the direction issued by the Writ Court.
The contempt application stands disposed of accordingly.
