1. The applicant has taken out present application seeking below mentioned relief and directions:
"Your Lordships be pleased to declare that Special Civil Application No.1847 of 2007 preferred by the petitioners stands abated qua respondent no.1 and Ad-interim relief granted by this Hon'ble Court may also stand vacated qua respondent No.1 in the interest of justice and equity"
2. Learned Advocate for opponent has submitted that the opponent has filed an application seeking order permitting the opponent to implead heirs of deceased i.e. original respondent No.1 in the petition. He also submitted that the application has been filed since 19th October 2011, however, for reasons not known to the applicant the said application is not circulated.
3. In view of the said submission, present application is disposed of with direction to present opponent to take necessary steps to ensure that the application which is said to have been filed by opponent is circulated for hearing and appropriate orders on or before 20th March 2012.
4. With the aforesaid clarifications and directions, the application is disposed of.
