No one appears on behalf of the appellants to press this appeal. We have heard Sri Bhanu Prakash Singh and Rajeev Kumar Rai, learned brief holders for the State.
By way of instant criminal appeal, challenge has been made to the validity and sustainability of the judgment and order of conviction dated 08.10.1984, passed by Sessions Judge, Pilibhit in Session Trial No. 25 of 1983 (State vs. Suchcha Singh & Others), Police Station - Hazara , District - Pilibhit, whereby all the appellants, namely, appellant no.1- Suchcha Singh, appellant no.2- Balbir Singh, appellant no.3- Baaj Singh, appellant no.4- Balkar Singh and appellant no.5- Gajjan Singh were sentenced to imprisonment for life under Section - 302/149 I.P.C., six months rigorous imprisonment under Section - 323/149 I.P.C. and one year rigorous imprisonment under Section - 324/149 I.P.C. Appellant no.1- Suchcha Singh and appellant no.4- Balkar Singh have also been convicted under Section - 148 I.P.C. and sentenced to one year rigorous imprisonment. Appellant no.2- Balbir Singh, appellant no.3- Baaj Singh and appellant no.5- Gajjan Singh have been convicted under Section - 147 I.P.C. and sentenced to undergo six months rigorous imprisonment. All the sentences have been ordered to run concurrently.
From perusal of the reports of Chief Judicial Magistrate, Pilibhit dated 31.03.2021 and 30.07.2021, it transpires that all the appellants, namely, appellant no.1- Suchcha Singh, appellant no.2- Balbir Singh, appellant no.3- Baaj Singh, appellant no.4- Balkar Singh and appellant no.5- Gajjan Singh, have died.
In view of above, this appeal is liable to be dismissed as abated. The present appeal is, accordingly, dismissed.
