1. Heard Sri Prem Prakash, learned counsel for the petitioner and learned Standing Counsel for respondents No.1 and 2. Sri Azad Rai, Advocate, has accepted notice on behalf of respondent No.3. Notice need not be issued to respondent No.4 at this stage.
2. The only relief sought in the writ petition is that Case No.238/274/744, (Subhawati Devi vs. Jaydhar) under Section 35 of U.P. Revenue Code, 2006 before Naib Tehsildar, Dhanupur, Tehsil Handia, District Prayagraj, respondent no.2, be directed to be decided expeditiously.
3. Learned Standing Counsel fairly states that in case the aforesaid case is still pending and has not been disposed of, the same will be considered and decided expeditiously.
4. As no useful purpose would be served in keeping the matter pending or calling for counter affidavit, as such, respondent No.2 is directed to decide the aforesaid case, expeditiously, in accordance with law, if there is no legal impediment in deciding the same, preferably within a period of six months from the date of receipt of a copy of this order downloaded from the website of the High Court, after hearing all the parties concerned.
5. Writ petition stands disposed of.
