Heard Sri S.K. Tiwari, learned Counsel for the petitioner, learned Standing Counsel for the State respondents and perused the record.
The present writ petition under Article 226 of the Constitution of India has been filed for the following relief:-
"I). Issue a writ order or direction in the nature of mandamus directing the respondent no.4 to forthwith remove the encroachment over Khasra No.1255 area 0.115 hectare, Khasra No.1285 area 0.061 hectare and Khasra no.1287 area 0.061 hectare Village Ghalauli, Pargana and Tehsil Deoband, District Saharanpur belonging to the petitioner and handed over the possession to the petitioner in pursuance of the order dated 28.08.2021 passed by respondent no.3."
Learned Standing Counsel on the basis of instructions received submits that the order dated 28.08.2021 passed by the Sub-Divisional Magistrate has already been implemented at the spot on 13.12.2021.
Learned Counsel for the petitioner has not disputed the instructions as received by learned Standing Counsel.
In view of the same, the writ petition is, accordingly, dismissed as having become infructuous.
The instructions received by learned Standing Counsel is taken on record.
